Order - paid customer’s request for purchase and delivery of the good, presented on the website. Information on the Goods, posted on the Website, is provided by the Seller.
Good - good presented on the Website, indicating the retail price, size and weight.
When ordering Goods via the Website, the Customer agrees to the Terms of sales of the Goods by the Seller, set forth in this document. This agreement, as well as Goods information presented on the Website, is public offer. Seller reserves the right to make changes to this Agreement.
INFORMATION PROVIDED BY THE CUSTOMER
When placing an Order on the Website, the Customer shall provide the following information and consents to its use, handling and storage by the Seller: Surname, Name, Email address, phone number, the payment address, delivery address.
Seller will use this information to fulfill his obligations to the Customer.
The Customer agrees to the transfer of the provided information by the Seller to third parties acting under contract with the Seller and on his behalf, in order to fulfill the obligations arising from the Customer’s Orders made on the Website and taken to processing, subject to the provisions of this Agreement.
Is not considered a violation of the obligations of confidentiality of personal information of the Customer its provision to the representatives of the public services, in cases stipulated by applicable legislation.
Specifying information and placing marks in the appropriate boxes when Ordering and registering at the Website, Customer expresses his acceptance of this Agreement.
Seller is not responsible for the information provided by the Customer at the Website in an accessible form to submit his goods review.
Seller is not responsibile in case the client specifies the wrong or incomplete delivery address. The client at his own expense pays the additional costs associated with the search for parcels sent to the wrong address.
The Order is made by the Customer himself on the Website at any time, 7 days a week.
When making the Order Customer fills the registration form data. To complete the Ordering on the Website the Customer confirms acceptance of the Terms and Conditions of sales of the Goods on the Website (this document). Ordering on the Website without Customer’s confirmation of the acceptance of Terms and Conditions is not performed.
After completing the Ordering data from the registration form passes to the Seller.
Customer who brings inconvenience and harm to the Website of his own will, may be blacklisted by the administration of the Website, and access to the Website from his IP is blocked.
THE TIMING OF THE ORDER
After ordering on the Website, Customer receives information about the acceptance of his Order to the specified Email address. The Email will contain the Order number and date, subsequent letters will reflect all the changes associated with the Order (successful confirmation of payment, registration of departure at the parcels sending point etc.) Order will be executed immediately after the payment, during working hours the nearest working day.
DELIVERY AND TRANSFER OF OWNERSHIP OF THE GOODS
Delivery of the Goods is carried out on the territory of the countries included in the list of agents of the international express delivery services.
Shipping cost of the Goods is calculated automatically at the checkout stage on the basis of the courier service tariffs, and depends on the destination and weight of the Good with packaging (gross).
Shipment of the Good from the Seller’s warehouse shall be made within 2 working days after the payment of the Good.
Term of delivery of the Good to the cities having international terminals of the courier services, is 2-5 business days for EU countries, and 8-12 business days for countries outside EU. Term of delivery in regions is defined by the rules of the courier services, and may increase by 3-5 business days.
Seller is not responsible for any delay in delivery due to customs clearance, as well as unforeseen circumstances that occurred through no fault of the Seller, which could not be foreseen.
PAYMENT FOR THE GOODS
Price of the Goods is indicated on the Website without the cost of delivery and customs payments. The invoice attached to the Order indicates the cost of the Goods including delivery but excluding customs duties.
The price of the Goods on the Website may be changed unilaterally by the Seller. The price of the Goods ordered by the Customer can not be changed.
All transactions between Customer and Seller are performed in euros, US dollars, British pounds or rubles, depending on the Customer’s choice.
Payment of Goods is carried by means of prepaid or credit card VISA, Master Card, Maestro, American Express, by PayPal or bank transfer. If you chose payment by bank transfer you will receive an Email with instructions and account details, after which you can pay for your purchase within one working day from the date of ordering, otherwise your order will be canceled.
Product reservation for 14 days is made by the Customer himself on the Website at any time, 7 days a week. In one order, you can reserve no more than one product.
The reservation is available for goods worth more than 50 €. To make a reservation, the Customer pays a guarantee deposit of 20 € (or in the selected currency at the rate), this amount is deducted from the total cost of the order.
The Seller undertakes to reserve the good for the Client for 14 calendar days from the day of reservation. During this period, several reminders on payment of the remaining part of the order will be sent to the E-Mail that Customer specified at the time of making the reservation.
In case the Customer does not contribute the rest of the order amount within 14 calendar days from the moment of reservation, the reservation is canceled and the deposit is not refunded.
Payment for reservation is possible with a credit card or with PayPal. The rest of the order amount is paid by the Customer by the same payment method as was used during reservation.
GUARANTEES FOR GOODS
In accordance with EU legislation, the Seller provides a mandatory guarantee (legal guarantee) for all goods purchased on the Site.
The guarantee period shall begin at the time when the goods are delivered. Provided that the Customer is a consumer, the period of limitation for statutory claims for defects is two years. If the Customer is a merchant the limitation period for guarantee claims is one year.
To repair or replace a product that has a defect on the manufacturer's fault, the defective product must be sent to us. After accepted by the Seller, the product is sent to the manufacturer for examination. After the defect is confirmed, the product will be repaired or replaced by the manufacturer at his expense. Manufacturer is authorized to choose between curing the defect and delivering a defect-free good. If such a product is absent at the factory and it is not possible to repair it, the refund is provided as a subsequent action.
If the return of defective product was made within 14 days from delivery, the client will be compensated for the back delivery cost. If the product failed during the guarantee period starting from 15th day and before the expiration of 2 years from the date of delivery, delivery cost is not refundable.
If the delivered item has been repaired or modified by the Customer or by a third party without written approval by the Seller, all guarantee rights shall expire.
Obvious defects in the products must be notified immediately after delivery, at the latest within fourteen days after receipt of the goods. If the Seller is not notified of the presence of such defects on time, the goods are deemed to have been approved and accepted, with all inherent guarantee rights expiring.
The Seller shall not be liable for normal wear and tear of the good or defects which are a result of incorrect or negligent handling or treatment or which are caused by unusual conditions of use.
CUSTOMS CONTROL AND DUTIES FOR RESIDENTS OF THE COUNTRIES OUTSIDE THE EU
At the borders of the countries that are not members of the European Union, the contents of your order may be subject to customs duties (which may include taxes, duties, handling fees, customs broker fee, etc.), in accordance with the customs legislation of these countries. Payment of these duties is the responsibility of the recipient of the order. Seller has no control over these charges. Please check with your country’s customs office for customs duties before checkout.
RETURN OF GOODS
It is possible to make a return of the Good within fourteen days from the date when it was received, while this period includes all weekends and holidays. It is necessary to communicate the intention to return the good filling out an application for a return. Only the person who placed the order and indicated their details in the invoice can issue a return request.
Return of Goods of good quality. Requirements for Good returned
● There is a document confirming payment of the good;
● The TutITALIA safety seal is intact and not damaged;
● The good has no damages and doesn’t look worn;
● The good is returned in a complete set (designer packaging and gifts (if present) are also considered a part of the set);
● The deadline for online application for return is 14 calendar days from the date of receipt of the order.
Accepted are returns of the Goods purchased on the Website only and only made by the person who made the order. If things are part of the set, only a complete set may be returned, and only in one package. Goods of the same order returned separately at different times and by different sendings, are non-refundable.
Website does not accept the return of Goods that do not meet all the required conditions. In this case the Goods will be sent back to the Customer’s address at his expense.
The amount of returned funds is calculated based on the price of the order, minus delivery cost. When the delivery cost is paid by TutITALIA online store (the so-called "free delivery"), the customer is not entitled to return the goods for personal reasons (without claims to the quality of the goods).
Refund shall be made within 10 banking days after arrival of the good to our warehouse, inspection and examination (if necessary). Money is returned to the Customer by bank transfer or bank card from which payment was made. Transfer of funds to a bank account or a bank card, from which payment was made, is carried out within 10 banking days after the arrival of the sending with the returned good at the TutITALIA warehouse, good inspection and examination. Term for funds to be credited to the Customer’s account, is determined by the internal regulations of the Customer’s bank, and is usually 1 business day after the receipt of funds in the bank.
Return of Goods of inadequate quality
In case of return of the Goods of inadequate quality, the amount of funds to be returned includes the cost of the Goods and delivery charges. The Good of the inadequate quality means a Good which has defects and can not enforce its functional qualities. Difference in design elements from those stated in the description on the Website and shown in an image, including color accuracy within acceptable margins, is not considered a defect or dysfunction of the Good and can not be regarded as a sign of the Good of inadequate quality.
Sending the parcel back
After registering the return application you should use traceable courier service (not ordinary Post!) to send the parcel with the good you return, to the address indicated by us in the response email.
In order that we can monitor the movement of the sending with the returning good, a scanned copy of the postal receipt must be sent to the Email address firstname.lastname@example.org
Customs documents to send returned goods
If your country is outside the EU, your package will have to go through customs again. To send it back you will need 5 copies of the proforma invoice. Download proforma invoice form
Transfer of funds to a bank account or a bank card, from which payment was made, is carried out within 10 banking days after the arrival of the sending with the returned good at the TutITALIA warehouse, good inspection and examination. Term for funds to be credited to the Customer’s account, is determined by the internal regulations of the Customer’s bank, and is usually 1 business day after the receipt of funds in the bank.
For hygiene reasons, no return will be accepted for items in contact with body parts: scarves, shawls, T-shirts, gloves, hats (art. 59 lettera "e" del D. Lgs 21 del 21/02/2014).
NEWSLETTERS AND INFORMATIONAL MESSAGES
When registering on the Website, the Customer may agree, at will, to receive the informational newsletters from the Seller. The Customer has the right to refuse these mailings.
The newsletters come in the form of an Email to the Email address specified by the Customer when placing the order or during registration. Promotional materials may be presented in the form of paper-printed products and souvenirs, enclosed in Customers orders and delivered to the specified postal address.
PROMOTIONS AND DISCOUNTS
In case of sales as well as other events, sales discount is not added to the accumulative and one-time discounts, including that accumulative is not summed with the one-time. In this case the largest of the discounts is valid.
